The Equine Law Firm have developed a Pre Purchase Questionnaire, to enable buyers to have a permanent record of representations made by a seller before a sale is concluded.
We wanted to share with you a document which we have devised to protect equestrians entering into a transaction. We are often instructed by buyers after a latent defect has arisen, and they find difficulty evidencing what was said verbally about the horse before the sale took place. This document may help protect your agreement.
PRE-PURCHASE QUESTIONNAIRE- GUIDANCE NOTES
You should read these notes carefully before you use the Pre-Purchase Questionnaire (PPQ).
Horses and ponies represent a significant investment of our time and money. We understand that it can be extremely distressing when the purchase of a horse does not go to plan. We are often consulted by buyers who have no record of verbal representations made to them before a sale about a horse’s suitability for their needs. Our PPQ aims to reduce the risk to buyers of being unable to prove those statements.
The PPQ is not a contract of sale. You should give careful consideration as to whether a separate written contract of sale is required. This document will not provide you with the same protection as a contract of sale. It will act as a permanent record of what the seller has told you before a sale is agreed, in case of any dispute. The PPQ should be completed by the seller, and not their agent or any party acting on their behalf.
You must ask the seller to complete the PPQ before a sale is agreed.
The PPQ is not intended to be an exhaustive list of questions which you should ask the seller before a sale is agreed. You should consider any issue which may be relevant to your requirements and ensure that you ask the seller to confirm the same. Give careful consideration as to whether you require any specific warranties, about, for example, height or fertility.
Keep the completed PPQ in a safe place. We recommend scanning a copy and uploading it to a secure device.
The PPQ should not be used as an alternative to a veterinary inspection or your own visual inspection.
